Safety Certification Ownership for Safety Training in Ontario

Summary (TLDR): Employers are responsible for training employees before they do the work. Employees own their Chief Prevention Officer (CPO) completion cards and record of completions.

Employers are responsible for paying the cost of training to ensure employees are competent and prepared for work. To some employers, it isn’t always immediately clear who should pay for the training and who ends up owning the certificate or record of completion needed to legally perform work in various industries. There is a bit of misinformation here in that a number of training courses are required but certification is seldom a requirement by the MLITSD. Generally, the rule of thumb is that a record of completion may be requested by the agency rather than a certification.
Here are the essential certifications that employers must pay for, however, the Chief Prevention Officer (CPO) training card is owned by employees:

  • Joint Health and Safety Committee (coming soon!) – members of the safety committee who have been certified own their CPO issued completion card.
  • Working at Heights Training – employees must receive training and keep their completion cards.

Most other training is required to be paid for by the employer with a record of completion to be presented to the labour agency if requested. Your company should also consider providing the relevant training courses below (for which the record of completion is owned by employees):

Safety certification ownership belongs to the employee and so does the record of completion for non-CPO regulated courses. It is the responsibility of employers to keep track of the training that employees have taken to demonstrate due diligence in adhering to the health and safety mandate of the Ministry of Labour, Immigration, Training and Skills Development. A record of completion must contain the following sets of information to be relevant during agency inquiries or requests:

  • Name of individual who completed the training
  • Date of completion
  • Description of the training course

Records are recommended by MLITSD to be kept at least for 6 months after a worker who has completed safety training leaves the organization.
