Joint Health and Safety Committee (JHSC)

What is a JHSC?

According to the Ministry of Labour, Immigration, Training and Skills Development, a Joint Health and Safety Committee (JHSC) consists of at least two people, who together represent the employer and workers at a specific workplace. Their main responsibility is to identify health and safety issues within the workplace and notify the employer about them.

The health and safety representatives have the power to do many things, which are outlined in Section 8 (11) of the OHSA. There are several benefits to having a JHSC, such as:

  • They help prevent hazards in the workplace
  • Increases organizational support for health and safety practices
  • Increases employee satisfaction by openly communicating ideas and perspectives
  • Encourages adherence to government guidelines to avert fines

When is a JHSC Required?

As per section 9 of the Occupational Health and Safety Act (OHSA), a JHSC is required:

  • At a workplace consisting of 20 or more regularly employed workers;
  • At a workplace where an order to an employer is in effect under section 33 of OHSA; or
  • At a workplace other than a construction project where there are less than 20 regularly employed workers, but where regulations concerning designated substances applies.

As for workplaces that don’t fit these descriptions, and they have more than 5 workers but less than 20, they are not required to have a JHSC. However, as per Section 8 (1) of the OHSA, workers are still expected to appoint a health and safety representative from amongst themselves who does not exercise managerial functions.
